New MPCA Soil Reference Values: Several residential soil reference values (RSRVs) for metals were reduced in 2005 including arsenic and copper. This created a lot of problems trying to reach these low cleanup goals for residential cleanups because the concentrations were near background levels. In December 2008, arsenic was increased from 5 mg/kg to 9 mg/kg and copper was increased from 11 mg/kg to 100 mg/kg.

New MPCA Guidance Requirements:
* A new format for the restrictive covenant or deed restriction was finalized in 2007 through the MPCA Attorney General office.
* The MPCA issued a new guidance document on vapor intrusion in September 2008. ASTM has also published a standard: ASTM E2600-08 Standard Practice for Assessment of Vapor Intrusion into Structures on Property Involved in Real Estate Transactions. We are now waiting for the follow-up technical guidance document on vapor intrusion from the MPCA.
* The MPCA VIC Program is also working on a soil reuse guidance document.
* The MPCA now requires reports to be in hard copy and electronic format.

May 2007. In early May, we were able to start disposing of nonhazardous mercury contaminated soil in Minnesota landfills again. This has been a significant cost savings opportunity for many contaminated sites. Give us a call to discuss with us further.
